Terms of Service

These Terms of Service ("Terms") govern your use of the PeptidePrescript website and services ("Service") operated by PeptidePrescript ("we," "us," "our"). By accessing our website or using our services, you agree to these Terms. If you do not agree, do not use the Service.

1. Overview of Services

PeptidePrescript is a telehealth platform that provides access to physician-supervised peptide consultations and care plans. We operate as a Management Services Organization (MSO) that provides technology, administrative, and operational support to independently owned Professional Corporations (PCs) staffed by licensed physicians.

Important: PeptidePrescript does not practice medicine, diagnose conditions, prescribe medications, compound medications, or ship medications. All clinical decisions, including whether to prescribe any medication, are made solely and independently by licensed physicians employed by or contracted through the PC. All medications are compounded and dispensed by separately licensed 503A compounding pharmacies.

2. Medical Emergency Disclaimer

THIS SERVICE IS NOT FOR MEDICAL EMERGENCIES. Electronic communication is not appropriate for all health issues, especially those of an urgent nature. PeptidePrescript does not guarantee any particular response time to inquiries. If you are experiencing a medical emergency, do not rely on this service - call 911 or go to your nearest emergency room immediately.

3. Compounded Medications Disclaimer

Compounded medications are not FDA-approved. The FDA does not evaluate compounded medications for safety, efficacy, or quality. Compounded medications are prepared by licensed compounding pharmacies based on a physician's prescription for an individual patient.

Category 1 compounding eligibility under FDA regulations is not the same as FDA drug approval. FDA drug approval requires formal clinical trials, safety and efficacy review, and manufacturing validation under a New Drug Application (NDA) or Biologics License Application (BLA).

Peptides described on our website as "studied for" a particular use reflect preclinical or early-stage research and do not represent proven efficacy or approved therapeutic indications.

4. Not a Guarantee of Treatment

Joining the waitlist, creating an account, or subscribing to a plan does not guarantee that you will be prescribed any specific medication or peptide. Your physician independently evaluates your health history, lab results, and clinical presentation to determine whether peptide prescriptions are appropriate for you. The physician may determine that no peptide is appropriate, or may recommend a different treatment approach.

No guaranteed outcomes. Individual results vary. We make no representations or warranties regarding specific health outcomes from any treatment prescribed through our platform.

5. Eligibility

  • You must be at least 18 years old to use our services.
  • You must be located in a state where our physicians are licensed and our services are available.
  • You must provide accurate, complete, and current information during registration, intake, and consultations.
  • You must not use our services if you have been advised by a healthcare provider that peptide therapy is contraindicated for you.

6. Account Registration and Security

When you create an account with PeptidePrescript, you are responsible for maintaining the confidentiality of your login credentials, including your username and password. You agree to:

  • Create a strong, unique password and not reuse passwords from other services.
  • Not share your account credentials with any other person.
  • Not allow any other person to access or use your account.
  • Notify us immediately at legal@peptideprescript.com if you become aware of any unauthorized access to or use of your account.

You are responsible for all activity that occurs under your account, whether or not you authorized that activity. PeptidePrescript is not liable for any loss or damage arising from your failure to safeguard your login credentials. We reserve the right to suspend or disable any account if we reasonably believe the account has been compromised.

7. Waitlist

The waitlist is a no-cost, no-obligation signup to receive notifications about service availability, launch updates, and peptide reclassification alerts. Joining the waitlist does not create a physician-patient relationship, does not constitute a medical consultation, and does not obligate you to purchase any service.

Waitlist position and early access pricing are provided on a first-come, first-served basis and are subject to availability. We reserve the right to modify waitlist benefits at any time.

8. Subscriptions and Payment

Pricing

Our monthly plans are billed on a recurring monthly basis at the rate displayed at the time of enrollment. Prices may change with 30 days' advance notice. Your plan includes the services described on the plan page at the time of enrollment.

What's included

Each plan includes physician consultations, lab work coordination, prescribed peptide medications (when clinically appropriate), and shipping. Specific peptides and treatment plans are determined by your physician and may vary by individual.

Cancellation

You may cancel your subscription at any time through your patient portal or by contacting us. Cancellation takes effect at the end of your current billing cycle. No refunds are issued for partial months. If you have received a medication shipment for the current month, that month is non-refundable.

Refunds

If your physician determines during your initial consultation that peptide therapy is not appropriate for you, and no prescription is issued, you are eligible for a full refund of that month's subscription fee. Refund requests must be submitted within 14 days. Refunds are processed to the original payment method within 5-10 business days.

9. Telehealth Consent

By using our services, you acknowledge and consent to receiving healthcare services via telehealth (video consultation). You understand that:

  • Telehealth involves the use of electronic communications to provide clinical services at a distance.
  • Telehealth is not a substitute for in-person medical care when in-person care is medically necessary.
  • There are potential risks to telehealth, including technology failures, interruptions, or limitations in the ability to perform a physical examination.
  • Your physician may determine that your condition requires an in-person evaluation and may refer you to a local provider.
  • You have the right to withdraw your consent to telehealth at any time.

A separate informed consent form will be provided prior to your first physician consultation.

10. SMS Messaging Terms

If you opt in to SMS messaging by providing your phone number and checking the consent box, you agree to receive automated text messages from PeptidePrescript. See our Privacy Policy Section 5 for full SMS terms.

  • Message frequency varies.
  • Message and data rates may apply.
  • Reply STOP to unsubscribe at any time.
  • Reply HELP for assistance.
  • Consent is not a condition of purchase or receiving services.
  • Your phone number will not be shared with third parties for marketing.

We comply with the Telephone Consumer Protection Act (TCPA) and applicable state regulations.

11. Physician-Patient Relationship

A physician-patient relationship is established only when a licensed physician conducts a clinical evaluation (via live video consultation) and agrees to provide care. Browsing our website, joining the waitlist, or creating an account does not establish a physician-patient relationship.

Physicians on our platform are independently licensed in the states where they practice and make all clinical decisions independently. PeptidePrescript (the MSO) does not direct, influence, or override physician clinical judgment.

12. Your Responsibilities

  • Provide truthful and complete health information to your physician.
  • Follow your physician's instructions regarding prescribed medications, including dosing, administration, and follow-up.
  • Report any adverse reactions or side effects to your physician promptly.
  • Attend scheduled consultations and follow-up appointments.
  • Do not share, sell, or transfer prescribed medications to any other person.
  • Do not use our services for any unlawful purpose.

13. Prohibited Conduct

You agree not to engage in any of the following prohibited activities in connection with the Service:

  • Account abuse: Creating multiple accounts, sharing account credentials, or selling or transferring your account to another person.
  • Impersonation: Misrepresenting your identity, age, location, or health information to obtain services or prescriptions under false pretenses.
  • Unauthorized access: Attempting to access another user's account, any non-public areas of the Service, or PeptidePrescript's computer systems or networks without authorization.
  • Scraping and automation: Using any automated means - including bots, crawlers, scrapers, or data-mining tools - to access, collect data from, or interact with the Service without our prior written consent.
  • Reverse engineering: Decompiling, disassembling, reverse engineering, or otherwise attempting to derive the source code or underlying algorithms of the Service.
  • Interference: Introducing viruses, malware, or other harmful code, or taking any action that disrupts, degrades, or impairs the integrity, performance, or availability of the Service.
  • Circumvention: Attempting to bypass, disable, or circumvent any security, authentication, or access-control measures of the Service.
  • Unauthorized commercial use: Using the Service or any content obtained from the Service for commercial purposes without our prior written consent, including reselling access to the platform or redistributing our content.
  • Medication diversion: Using the Service to obtain prescriptions for the purpose of reselling, distributing, or providing medications to persons other than yourself.

Violation of any of these prohibitions may result in immediate suspension or termination of your account, forfeiture of any prepaid fees, and referral to law enforcement where appropriate.

14. User Content and Submissions

In the course of using the Service, you may submit information to us, including but not limited to health history, intake forms, consultation notes, messages, lab results, photographs, and other materials ("User Content").

Ownership

You retain ownership of your User Content. However, by submitting User Content to the Service, you grant PeptidePrescript a non-exclusive, royalty-free, worldwide license to use, store, process, and transmit your User Content solely as necessary to operate the Service, facilitate your clinical care through the PC, communicate with you, comply with legal obligations, and improve our platform. This license does not grant us the right to sell your User Content or use it for advertising purposes.

Accuracy

You represent and warrant that all User Content you submit is accurate, complete, and current to the best of your knowledge. You acknowledge that clinical decisions made by your physician rely on the information you provide, and that inaccurate or incomplete information may result in inappropriate care or adverse health outcomes. PeptidePrescript and the PC are not liable for consequences arising from false or misleading User Content.

Protected health information

User Content that constitutes protected health information (PHI) is handled in accordance with our Privacy Policy and applicable HIPAA regulations. See our Privacy Policy for full details on how your health information is collected, used, stored, and disclosed.

15. Intellectual Property

All content on our website - including text, graphics, logos, design, and software - is the property of PeptidePrescript and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

16. Third-Party Links and Services

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by PeptidePrescript. This includes, but is not limited to, compounding pharmacies, laboratory testing providers, payment processors, and educational references.

PeptidePrescript has no control over and assumes no responsibility for the content, privacy policies, practices, or availability of any third-party websites or services. Links to third-party resources do not imply endorsement by PeptidePrescript.

Your interactions with third-party service providers - including compounding pharmacies and laboratories - are governed by those providers' own terms, policies, and regulatory obligations. PeptidePrescript is not a party to and is not liable for any disputes between you and a third-party provider.

17. Service Availability and Warranty Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, PeptidePrescript disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Without limiting the foregoing, PeptidePrescript does not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • The results obtained from the Service will be accurate or reliable.
  • The quality of any services, information, or other material obtained through the Service will meet your expectations.
  • Any errors in the Service will be corrected.

We may perform scheduled or unscheduled maintenance, updates, or upgrades that temporarily affect the availability of the Service. We will make reasonable efforts to provide advance notice of planned maintenance but are not obligated to do so.

No advice or information, whether oral or written, obtained from PeptidePrescript or through the Service shall create any warranty not expressly stated in these Terms.

18. Limitation of Liability

To the maximum extent permitted by law, PeptidePrescript (the MSO) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to adverse reactions to prescribed medications, delays in service availability, or technical failures.

PeptidePrescript does not practice medicine and is not liable for clinical decisions made by physicians. Clinical liability, if any, rests with the prescribing physician and the Professional Corporation through which they practice.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

19. Indemnification

You agree to indemnify and hold harmless PeptidePrescript, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your violation of these Terms, your misuse of the Service, or your provision of false information.

20. Termination

Termination by you

You may close your account at any time by contacting us at legal@peptideprescript.com or through your patient portal. If you have an active subscription, cancellation terms in Section 8 apply.

Termination by us

We reserve the right to suspend or terminate your account, with or without notice, for any of the following reasons:

  • Violation of these Terms, including any prohibited conduct described in Section 13.
  • Provision of false, misleading, or fraudulent information.
  • Conduct that we reasonably believe poses a risk to the safety or security of other users, our staff, or third parties.
  • Non-payment of fees owed.
  • Extended inactivity, as defined by our account policies.
  • As required by law, regulation, or legal process.

Effect of termination

Upon termination of your account, your right to access and use the Service ceases immediately. We are not obligated to retain or provide you with copies of any User Content in your account, except as required by applicable law (including medical records retention requirements). Any prepaid fees for the current billing period are non-refundable upon termination for cause. The following sections survive termination: Section 14 (User Content and Submissions), Section 15 (Intellectual Property), Section 17 (Service Availability and Warranty Disclaimer), Section 18 (Limitation of Liability), Section 19 (Indemnification), Section 22 (Dispute Resolution), Section 23 (Governing Law), and this Section 20.

21. Recording Consent

Any phone call, video consultation, or other communication made to or received from PeptidePrescript or its affiliated physicians may be recorded for training, quality assurance, and compliance purposes. By using our services, you consent to the recording of such communications to the extent permitted by applicable law.

22. Dispute Resolution, Arbitration, and Jury Trial Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.

Informal resolution first

Before initiating any formal dispute proceeding, you agree to first contact us at legal@peptideprescript.com with a written description of your claim, including your name, account information, and the relief you seek ("Notice of Dispute"). We will attempt to resolve the dispute informally within 60 days of receiving your Notice. If the dispute is not resolved within that period, either party may proceed to arbitration as described below.

Binding arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your relationship with PeptidePrescript - including the validity, enforceability, or scope of this arbitration provision - shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted by a single arbitrator in the State of California (or, at your election, your county of residence within the United States). Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Arbitration fees

PeptidePrescript will pay all AAA filing fees and arbitrator costs for claims under $10,000, provided the arbitrator does not determine the claim to be frivolous. For claims above $10,000, fees and costs are allocated according to the AAA Consumer Arbitration Rules. Each party bears its own attorney's fees unless the arbitrator awards fees to the prevailing party under applicable law.

Class action and collective relief waiver

You and PeptidePrescript agree that any arbitration or court proceeding shall be conducted solely on an individual basis and NOT as a class action, collective action, private attorney general action, or any other representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this waiver is found to be unenforceable as to a particular claim or request for relief, that claim or request shall be severed and proceed in a court of competent jurisdiction while the remaining claims proceed in arbitration.

Small claims exception

Notwithstanding the above, either party may bring an individual action in small claims court in the State of California (or your county of residence) for disputes within that court's jurisdictional limits, provided the action remains on an individual (non-class, non-representative) basis.

Injunctive relief exception

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights, enforce confidentiality obligations, or prevent irreparable harm pending the outcome of arbitration.

Opt-out right

You may opt out of this arbitration provision by sending a written notice to legal@peptideprescript.com within 30 days of first accepting these Terms. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of the arbitration and class action waiver provisions. If you opt out, the remaining Terms continue to apply.

Jury trial waiver

JURY TRIAL WAIVER: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND PEPTIDEPRESCRIPT EACH WAIVE ANY RIGHT TO A JURY TRIAL IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.

23. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.

24. Force Majeure

PeptidePrescript shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, epidemics, government actions or orders, changes in law or regulation, war, terrorism, civil unrest, labor disputes, utility or telecommunications failures, cyberattacks, supply chain disruptions, or acts of God.

During any such event, our obligations under these Terms are suspended for the duration of the force majeure event. If a force majeure event continues for more than 90 consecutive days, either party may terminate these Terms by providing written notice to the other party.

25. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

26. Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Any attempted assignment in violation of this section is void.

PeptidePrescript may assign, transfer, or delegate its rights and obligations under these Terms, in whole or in part, without restriction and without notice to you, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.

27. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements or policies expressly incorporated by reference, constitute the entire agreement between you and PeptidePrescript regarding your use of the Service. These Terms supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the Service.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of that provision or any other provision. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

28. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
